Terms of Service

1. Acceptance

By accessing or using Varsitywell (“the platform”) you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. Who may use Varsitywell

The platform has two account types:

  • Graduate accounts — open to any person who is currently enrolled in or has graduated from a South African university or higher-education institution.
  • Employer accounts — open to companies and organisations that hire graduates directly into their own workforce.

You must be 18 years or older to register. By registering you confirm that the information you provide is accurate and up to date.

3. No recruiters

Recruitment agencies, staffing firms, and third-party recruiters are expressly prohibited from registering employer accounts or accessing candidate data on Varsitywell.

An employer account may only be used by a company to hire graduates into roles within that company. Reselling, sub-licensing, or otherwise providing access to candidate information to any third party — including affiliated agencies — is a material breach of these terms.

Varsitywell reserves the right to terminate any account it reasonably believes is operated by or on behalf of a recruitment agency, with no obligation to refund any subscription fees paid.

4. Prohibited use — data mining and scraping

You may not use Varsitywell, or any data obtained from it, to:

  • Scrape, harvest, or systematically extract profile data by automated or manual means for storage outside the platform.
  • Populate, enrich, or enhance any other database, CRM, ATS, or third-party service with data sourced from Varsitywell profiles.
  • Build or train machine learning models, AI systems, or similar technology using data collected from the platform without our prior written consent.
  • Contact, market to, or solicit users discovered through the platform outside of the platform's own messaging tools or after obtaining explicit consent via the platform.

All data on the platform is the property of the individual users who submitted it. Varsitywell acts as a custodian of that data at the user's request. Misuse of this data may attract liability under the Protection of Personal Information Act (POPIA), the Electronic Communications and Transactions Act (ECTA), and other applicable South African and international law.

5. Graduate responsibilities

As a graduate you agree to:

  • Provide accurate information about your qualifications and experience.
  • Keep your profile up to date, including publishing it when you are actively looking for work.
  • Notify us if you secure a position so we can update your status.
  • Provide valid bank details to receive earnings from profile unlocks.

6. Employer responsibilities

As an employer you agree to:

  • Only access candidate profiles for the purpose of evaluating candidates for genuine employment opportunities within your organisation.
  • Not share unlocked profile data with parties outside your organisation.
  • Comply with all applicable labour, data protection, and employment-equity legislation when hiring candidates found on the platform.
  • Pay subscription fees and per-profile unlock fees as agreed at checkout.

7. Payments and refunds

Employer subscriptions are billed monthly via Stripe. Profile unlocks are one-time payments. Subscription fees are non-refundable once a billing period has commenced. Profile unlock fees are non-refundable once the profile has been unlocked and viewed. If you believe a payment was made in error, contact us within 7 days at hello@varsitywell.co.za.

8. Graduate earnings

A portion of each profile unlock fee is credited to the graduate whose profile was unlocked. The current split is published on the Pricing page. Earnings are paid monthly to the bank account on file. We reserve the right to adjust the split with 30 days' notice to affected graduates.

9. Platform promotion and profile boosting

By registering on Varsitywell you grant us a limited licence to use your publicly visible profile information (name, degree, headline, skills) to promote the platform. This may include:

  • Featuring your profile in Varsitywell marketing materials, social media, or advertisements.
  • Boosting your profile via paid advertising or partner channels to increase your visibility.

We will never use sensitive private information (contact details, bank details, transcripts) in promotional activity. You may opt out of promotional use at any time by emailing hello@varsitywell.co.za. Opting out does not affect your platform access or earnings.

10. Intellectual property

The Varsitywell platform, brand, and codebase are owned by Varsitywell and its licensors. User-submitted profile content remains the property of the user. By submitting content you grant Varsitywell a licence to display it to relevant employers and, where applicable, in promotional materials as described in Section 9.

11. Limitation of liability

Varsitywell provides a marketplace for graduates and employers to connect. We do not guarantee that use of the platform will result in employment or in hiring a suitable candidate. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the platform.

12. Termination

We may suspend or terminate any account that violates these terms, with or without notice. Graduates may delete their account at any time. Employer accounts may be cancelled at any time via the billing portal; access continues until the end of the current billing period.

13. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

14. Changes to these terms

We may update these terms from time to time. Registered users will be notified by email of material changes. Continued use of the platform after changes take effect constitutes acceptance.
